Definitions :
“Event” means the event for which you have retained use of event space;
“Your company / You” means the client who is engaging JAMZ Creamery for the Event.;
“Us / We / Our” means JAMZ Creamery and it’s designees or assigns
“Event Date” means the date of the Event
“Fees” means the fees agreed upon between You and Us as set out in the reservation form and/or relevant invoice;
Terms:
1. Service:
Client and invited guests will have exclusive use of event space as set forth in the reservation form and/or invoice. Clients purchasing our Base Package may provide MP3 audio files and/or MP4 video files for presentation during their event. Clients purchasing Space Rental are granted access to the event space as set forth in the event package details on our website.
a. Duration
The duration of the event, as set out in the reservation form and/or relevant
invoice, will include set up and break down. Clients purchasing Decor Add-Ons
are excluded from set up and break down time requirements, as set up and
breakdown are managed by JAMZ staff. All other clients are advised to
reserve ample time to complete set up and break down of event equipment,
decorations, etc. Any time in excess of the reserved period may be billed at $75
per hour or fraction thereof.
b. Vacating
Client agrees to leave the event space in a clean an orderly manner following
their event. A Cleaning Fee may be imposed for failure to remove trash, dirt or
debris. Client agrees to be responsible any damages caused by client or guests in
attendance.
c. Reservations
Reservations can be made up to 60 days prior to Event Date. Reservations made
less than 7 days in advance may be subject to additional fees. Reservations
can not be guaranteed until deposit has been paid.
2. Payment:
Fees shall be agreed as stated in the reservation form and/or relevant invoice. A nonrefundable deposit of 50% is required to confirm reservation of the Event. The remaining 50% is due on the Event Date and must be settled prior to start of the event. Payment may be made by cash or card. A processing fee 3.5% will be applied to all electronic payments.
3. Cancellation:
In the event of cancellation by the client, the deposit paid is non-refundable. Should the event be rescheduled to commence within 6 months of the original event date, the forfeited deposit may be applied to the the then current event package price.
4. House Rules:
Number of guests may at no time exceed 50. No weapons or illegal drugs are permitted on the premises. Client agrees to adhere to all laws, rules and regulations. Client agrees to facilitate event within the parameters of their purchased event package and in a manner that is conducive to the health and safety of JAMZ staff and all guests in attendance
5. Termination:
We reserves the right to terminate the event without notice should we deem the event unsafe, illegal, or outside of the best interest of our company, or event attendees. Refunds for events terminated due to the negligence of client or guests of the client are at the sole discretion of JAMZ Management.
6. Liability
7. Permission:
You confirm that the JAMZ Creamery is given the right and permission to use any and all images, both photographic prints and digital images and videos or other recording media, in their advertising, display, website and internet promotion, or any other promotional purpose. You release JAMZ Creamery and its representatives and assigns from all claims and liability relating to said photographs, videos or recording media.
8. Indemnity:
You shall indemnify and JAMZ Creamery harmless against any and all actions, proceedings, demands, claims, liabilities or damages, costs or expenses arising as a result of: (a) any omission, breach or non-compliance by you of these terms and conditions; and (b) any act or omission by your guests and/or any individuals or entities participating in or attending the Event and any form of injuries, disputes, damages, damages to property, indirect loss, direct loss, consequential loss or deaths arising or resulting therefrom during, before, and after the said Event; including without limitation, those arising from or in connection with third party claims for breach of contract, personal injury, damage and/or loss, defamation, failure to obtain the relevant licenses, the infringement of any patent, trademark, copyright or other intellectual property rights.
9. All terms & conditions will be deemed to be agreed and accepted once the Event is executed and shall be binding on you with or without physical signature prior to the Event Date.
10. Governance
This Agreement and its terms and conditions are governed by and are to be construed in accordance with the laws of the State of California and the Parties hereby irrevocably submit to the exclusive jurisdiction of the courts of California.
